Aber sicher. Beide Seiten müssen dem Gericht ihre Auffassung darlegen. Und dann muss es von Amts wegen prüfen, wie die Lizenzbedingungen zu verstehen sind. Das heißt, ob wir sie richtig verstanden haben und die Auslegung von Borland eine unzulässige Einschränkung der Lizenzbedingungen darstellt oder nicht. Und dabei muss dann auch der angebliche Gewinn bewiesen werden.

Bei den Lizenzbedingungen ging es um einen privatrechtlichen Vertrag und dessen Auslegung. Dein Beispiel ist damit in keinster Weise vergleichbar.

In der Lizenz der Delphi 7 Personal von Borland.pl steht:

Das dürfte wohl sinngemäß das selbe sein, was in der deutschen Version von der c't steht. Möglicherweise gibt es auch Unterschiede zwischen den Kauf- und Downloadversionen.
